What Is This

The American Tort Reform Association published the Tort Reform Record in June, 2017. Forty states have modified the rule of joint and several liability, and Tennessee abolished joint and several liability by judicial decision.

Why It's Important

Joint and several liability allows a defendant only minimally liable for a given harm to be forced to pay the entire judgment, where the co-defendants are unable to pay their share. Many states have enacted reforms, moving to proportionate liability, which requires each co-defendant to be proportionally liable for the plaintiff’s harm, enabling businesses to better manage risks and liabilities.
